In March, when I first wrote about how the biotech rider—called the Monsanto Protection Act by its vocal opponents—undercut the constitutional concept of separation of powers, it seemed hardly anyone (other than the usual advocacy groups) was paying attention. But then a lot of people got mad, really mad.
Within a few short weeks the issue exploded in the mainstream media, with the surest sign the issue had hit the big time being (what else?) coverage by The Daily Show (hilariously entitled, “You Stuck What Where?”). Another indication was outrage even from a Tea Party blogger.

Last week, Monster Beverage filed an unusual lawsuit against the San Francisco City Attorney’s office to stop an attempt to place restrictions on the company’s highly caffeinated and potentially harmful products aimed at youth. This aggressive move is a form of backlash against using the legal system to hold the food and beverage industry’s accountable for deceptive marketing practices.

Recent reports of secret meetings among industry reps and the Food and Drug Adminstration over GMO labeling piqued my interest, mostly because this critical aspect was missing: any effort to label GE foods at the federal level could bring the current grassroots movement to a grinding halt by preventing any stronger local laws from ever being enacted. But I am getting ahead of myself.

California’s Proposition 37, which would have required labeling of GMO foods, died a painful death last night. Despite polling in mid-September showing an overwhelming lead, the measure lost by 53 to 47 percent, which is relatively close considering the No side’s tactics.

I recently attended the annual gathering of the largest trade group of nutrition professionals, which I also covered last year. Look out for complete report from me in the coming months. Meantime, I am pleased to share the experience of one registered dietitian, Andy Bellatti.
The Academy of Nutrition and Dietetics (AND) hosted its 2012 Food & Nutrition Conference and Expo (FNCE) earlier this month. Sadly, the event once again (see last year’s report) demonstrated how this registered dietitians’ accrediting organization drags its own credential through the mud by prioritizing Big Food’s corporate interests over sound nutrition and public health.

Last month, I wrote about how the food industry has hired powerful consultants with ties to Big Tobacco to oppose California’s Proposition 37, which would require labeling of all genetically engineered foods. Now, the No on 37 campaign (ironically named the “Stop the Deceptive Labeling Scheme”) is putting up alleged scientific experts to do its bidding, once again taking a page from the tobacco industry playbook.

In my role as policy consultant for the Center for Food Safety (CFS), I recently wrote about how the Obama Administration is playing politics and putting public health at risk by stalling on critical food safety regulations needed to implement the Food Safety Modernization Act. I am happy to report that the lawyers at Center for Food Safety aren’t waiting any longer. Along with the Center for Environmental Health, CFS has filed a lawsuit in federal court against both the Food and Drug Administration and the White House Office of Management and Budget for failing to comply with mandated statutory deadlines.

The United Fresh Produce Association Foundation says it’s “proud to be a Founding Partner of the Let’s Move Salad Bars to Schools Initiative.” I thought the First Lady should know this trade group is responsible for killing a vital produce testing program that helps keep kids safe from infection.
Dear Mrs. Obama,
I am writing out of deep concern over Let’s Move’s partnerships with the United Fresh Produce Association and the Produce Marketing Association. These two groups have lobbied to kill a vital pathogen testing program. While the Let’s Move Salad Bars to Schools program is to be applauded, its association with these trade groups is not.

In a long-awaited decision, last week the Food and Drug Administration disappointed health advocates once again by allowing Bisphenol A or BPA, a known endocrine disruptor, to remain approved as a chemical additive in food containers such as plastic bottles and metal cans.While the agency says it’s still studying the matter, many groups say the science is clear enough.
